Bookings for our Highlands Reserve villa are valid only after the on-line booking form has been completed and the terms and conditions accepted, the appropriate deposit has been paid, and we have issued a confirmation invoice. Please check the confirmation invoice carefully when you receive it and advise us if you think that anything is wrong since this confirmation invoice details what we have agreed to provide. By completing the on-line booking form the party leader accepts these booking conditions on behalf of all persons named on the booking form (including those substituted or added by any subsequent amendments). A contract exists between us when you have paid a deposit and we have issued the confirmation invoice. The deposit is non refundable.
A non refundable deposit of 25% of the rental charge is payable at the time of booking. The balance shown on the confirmation invoice must be paid by the due date which is not less than 10 weeks prior to the commencement date of the rental period. Bookings made within 10 weeks of the commencement date of the rental must be accompanied by full payment of the total rental.
If you cancel your holiday
If after acceptance of the booking for your Florida vacation rentals you cancel your arrangements or do not pay the balance of the rental cost shown on the confirmation invoice by the due date we reserve the right to cancel the booking and you will forfeit your deposit. In addition, if either event occurs within 10 weeks of departure the following cancellation fees become payable by you.
■ More than 70 days - deposit only
■ 70 - 56 days - 50%
■ 56 days or less - 100%
Any cancellation must be notified to us in writing and signed by the Party Leader and becomes effective on the date it is received by us. Such notification should be sent by recorded delivery.
Cancellation by us
In the event that cancellation by us becomes necessary we undertake that notice of cancellation will be given as soon as possible. On notification of cancellation you will receive a full refund of all monies paid, without interest or other compensation. The maximum amount you will be entitled to is the total monies paid under the booking contract.
A security deposit of £300/$400 is payable with the final balance to cover the cost of any breakages, losses or damage incurred whilst staying in the villa. The deposit will be returned to you when confirmation is received from the Management Company that no breakages, losses or damage have occurred to the property, its furnishings or contents during the rental period. All or part of the security deposit may be retained by the owners to cover excess cleaning costs, replacement or repairs to the villa or its contents, or excessive utility bills caused by external doors or windows being left open whilst the air conditioning is on.
It is the responsibility of the Party Leader to check the inventory and any discrepancies should be reported to the Management Company as soon as possible after arrival at the property.
You are responsible and liable for all damage, breakages and losses which occur during your stay. You should notify the Management Company immediately of any such occurrences and arrange for either replacement or repair of the items concerned. In the event of damage, breakages or losses being discovered after your departure, the cost of repair or replacement will be deducted from your security deposit. Where the cost of replacement or repair exceeds the security deposit you will remain liable for payment of all associated costs. You are also responsible for notifying the management company of any sudden failure of equipment within the property so that reasonable steps can be taken to effect a repair.
Arrival and departure times
Unless otherwise agreed in writing, access to the property is not allowed until after 4.00pm local time on the day the rental commences and the property must be vacated by 10.00am on the day of departure. Departure after 10.00 am will be subject to a charge of £40/$50 which will be deducted from the security deposit.
Occupancy of the property
Occupancy of the property is limited to a maximum of twelve persons and only those named on the booking form will be permitted to occupy the property during the period of rental. The property is located in a residential area and certain standards of behaviour are expected by the local community. Please review the Guest manual for guidance on local regulations and bye-laws. You are requested to observe the local regulations and we reserve the right to terminate the agreement without notice should any members of the party cause annoyance, distress, damage or danger to the property, its owners or any third party. In the event of such termination no refund will be made. Please note that SMOKING AND PETS ARE NOT ALLOWED IN THE PROPERTY.
Personal Travel Insurance
It is a condition of the booking that all members of the party are covered by travel insurance which carries adequate protection against delays and cancellations and has adequate medical insurance cover for the USA and for your luggage and personal belongings.
We accept no liability to pay compensation in respect of any loss or damage or changes arising from unforeseeable circumstances beyond our control including (but not limited to) war, or threat of war, riots, civil strife, industrial disputes, airline technical problems, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions.
The owners and their agents do not accept any liability for death, personal injury, accidents, loss or damage to persons or personal effects howsoever caused as a result of the use of the villa or any of its facilities including the swimming pool. The maximum compensation payable for any action arising out of or in connection with this contract shall not exceed the amount paid to us for the rental under the contract.
Law and severability
It is agreed by all parties that any action arising out of or in connection with this contract will be governed by English Law and exclusive jurisdiction is conferred on the English Courts. Should any part of this contract be deemed to be void by rule of law, the remainder of this contract will continue in full force and effect.
